FINDING OF NO SIGNIFICANT IMPACT Operations Permit Application for ENREMA, LLC Smarsh Project for Oil Wells within the Clear Creek Easement of the Obed Wild and Scenic River, Morgan County, Tennessee

In compliance with the National Environmental Policy Act of 1969 (NEPA), the National Park Service (NPS) prepared an Environmental Assessment (EA) to examine alternatives and evaluate potential environmental impacts associated with ENREMA, LLC (ENREMA)'s proposed Smarsh Project within the Clear Creek Easement of the Obed Wild and Scenic River (park). ENREMA is the operator of five non-federal oil and gas wells within the park. The NPS is using the NEPA process to evaluate potential impacts to park resources from ENREMA's proposal. The NPS's objectives are to prevent or minimize impacts on park resources and values, protect human health and safety and provide for safe visitor experience in the vicinity of the wells, avoid impairment of park resources and values, and ensure that ENREMA can exercise its mineral rights.

This Finding of No Significant Impact (FONSI) is the decision document for the ENREMA EA dated June 16, 2021. The EA evaluated two alternatives: a No-Action Alternative and the Proposed Action/Preferred Alternative. The EA analyzed the potential impacts these alternatives would have on the park's natural and cultural resources and the human environment. The EA and FONSI have been prepared in accordance with NEPA, as amended, 42 U.S. Code § 4321 et seq.; the NEPA implementing regulations of the Council on Environmental Quality, 40 Code of Federal Regulations (CFR) Parts 1500-1508; the Department of the Interior NEPA implementing regulations, 43 CFR Part 46; and NPS Director's Order #12: Conservation Planning, Environmental Impact Analysis, and Decision-making, and the accompanying NPS NEPA Handbook (2015). Attached to this document is the NPS determination that the Selected Alternative will support the protection of resources and values at the park and that no impairment to those resources will result (Appendix A). The NPS will implement the Selected Alternative, Alternative 2 - the Proposed Action and Preferred Alternative, as presented in the EA and summarized below.
