Pursuant to 36 C.F.R § 9.52 (a), the Superintendent of Cuyahoga Valley National Park gives notice that M&M Royalty, Ltd. (M&M) proposes to prepare a Plan of Operations for the proposed drilling of three wells on privately owned property in Walton Hills, Ohio within the boundary of Cuyahoga Valley National Park.

Two wells will be located on the Astorhurst Golf Course off of Dunham Road and one will be located north of the golf course and south of Tinkers Creek on adjacent private property at 6890 Dunham Road. If productive the wells on the golf course would produce into an existing tank battery at the golf course maintenance yard. The well at 6890 Dunham Road would produce into a separate tank battery near the wellhead. All of the wells would have flow lines that follow existing roads to an existing sales line at Dunham Road.

A Plan of Operations was received by the park, and the Superintendent published a notice of availability of the Plan of Operations and its associated Environmental Assessment (EA) in the Federal Register on July 10, 2009 starting a formal 30-day public review. These documents were available for public review from March 3, 2009 until August 9, 2009.

The NPS has selected Alternative B, the Proposed Action as outlined in the Plan of Operation for implementation. A Finding of No Significant Impact (FONSI) was signed on August 27, 2009.
