The FHWA served as the lead Federal agency and VDOT was the co-lead agency and Arlington County was the local project sponsor. As a cooperating agency and in accordance with CEQ regulations at 40 CFR 1501.6, the NPS actively participated in the NEPA process for CC2DCA. The FHWA signed its Finding of No Significant Impact (FONSI) on July 24, 2024. (Appendix A)
After consultation with Arlington County, VDOT, and FHWA, and review of the EA and other supporting documentation, the NPS, in accordance with 43 CFR 46.320, is adopting the EA and making its decision to authorize the use of land within the Parkway by Arlington County to construct the CC2DCA for the use of approximately 0.03 acres of land and 0.21 acres of air rights from the Parkway to accommodate piers for the new structure and for a new ramp connecting to the Mount Vernon Trail via a Highway Easement Deed to Arlington County through FHWA. The NPS concludes that the EA fulfills the requirements of the National Environmental Policy Act (NEPA) and applicable implementing regulations (40 CFR 46.120), and meets the policies set forth in the NPS Director.s Order 12, Conservation Planning, Environmental Impact Analysis and Decision-making, and NPS 2015 NEPA Handbook.
The Federal actions that will be undertaken by the NPS include the temporary use of land under its jurisdiction through a Special Use Permit for construction of CC2DCA across the Parkway and the permanent use of land under its jurisdiction through a Highway Easement Deed, pursuant to the authority of 23 U.S.C 107(d), which will grant a non-exclusive easement to Arlington County for highway purposes as to allow Arlington County to maintain and operate the CC2DCA. Upon NPS concurrence with a Letter of Consent from FHWA, the FWHA will develop and execute a non-exclusive Highway Easement Deed to Arlington County for highway purposes to allow for the operation and maintenance of structures built and developed under the Selected Alternative on NPS lands and within NPS air rights.
