Memorandum of Agreement between the NPS and SHPO
BACKGROUND: Yosemite National Park is planning the removal of the Concessioner Headquarters Building to implement the Merced Wild and Scenic River Comprehensive Management Plan (Merced River Plan) as approved in the June 2014 Record of Decision after completion of an Environmental Impact Statement. Removal of this contributing building will result in an adverse effect to the Yosemite Valley Historic District. To resolve the adverse effect, the park and the California State Historic Preservation Office (SHPO) have drafted the attached Memorandum of Agreement (MOA) which is available now for public review.
WHAT IS A MEMORANDUM OF AGREEMENT? Section 106 of the National Historic Preservation Act (NHPA) requires federal agencies to consider the effects of their proposals on historic properties and provide state/tribal historic preservation offices and the Advisory Council on Historic Preservation (ACHP) a reasonable opportunity to review and comment on those actions. This memorandum of agreement (MOA) between the SHPO and Yosemite National Park documents the terms and responsibilities of the signatory parties to address the adverse effects to the Yosemite Valley Historic District resulting from the planned action to remove the Concessioner Headquarters Building.
An MOA is a legally binding document that commits an agency both by statute and by federal regulation to carry out an undertaking in accordance with the terms of the agreement in satisfaction of its responsibilities under Section 106. The MOA serves three main purposes: (1) to specify the alternatives or mitigation agreed to by the signatories; (2) to identify who is responsible for carrying out the specified measures; and (3) to serve, along with its implementation, as evidence of the agency's compliance with Section 106 of the National Historic Preservation Act.
